Probate Process in Texas

The process of taking a home through probate in Texas can be a complex and time-consuming process. Here are the basic steps involved:

  1. Filing the probate application: The executor of the estate or a beneficiary of the will must file an application for probate with the county clerk of the county where the deceased person lived.
  2. Notifying heirs and creditors: Once the probate application is filed, the court will issue a notice to all interested parties, including heirs and creditors, informing them of the probate proceeding.
  3. Appointing an executor: The court will appoint an executor to manage the probate process, pay any outstanding debts, and distribute the assets of the estate.
  4. Inventorying the assets: The executor must prepare an inventory of all the assets of the estate, including the home.
  5. Paying debts and taxes: The executor must pay any outstanding debts of the deceased person, as well as any taxes owed by the estate.
  6. Selling the home (if necessary): If the deceased persons will require the home to be sold or if the home needs to be sold to pay off debts, the executor must sell the home.
